Legal Updates and Compliance Issues on the Horizon

This session will include a review of recent, important court decisions, settlement agreements and agency rulings. The decisions, rulings and agreements will be discussed from the perspective of their impact on institutional compliance practices and procedures.
Examples of the issues that will be discussed include:
— Accommodation Controversies: The proper process to follow in denying a student’s request. The minimum procedural standards to be followed in resolving accommodation disputes with faculty members.
— Essential Requirements: Common mistakes that institutions make in concluding that a requested academic adjustment will result in a fundamental alteration or undue burden.
— Access to Technology: Alternative text and captioning guidelines.
— Different Treatment: Administrative policies and procedures that lead to rulings of discriminatory treatment.
— Clinical Programs: The responsibility of institutions to ensure students with disabilities are provided equal access and to police the behavior of third parties.
— Animals: Fraudulent documentation, improper inquiries and impermissible restrictions.
